These terms govern your use of windandrose.com (the “site”). By accessing or using the site you agree to be bound by them. If you do not agree, please stop using the site.

Wind & Rose, LLC (“Wind & Rose”, “we”, “us”, “our”) is a Registered Independent Advisor based in New York. These terms apply to general visitors and to prospective clients. Once you become a client, the engagement is governed by the separate written agreement between us.

The site exists to introduce the firm, describe our philosophy and approach, and let prospective clients begin a conversation with us through the qualification form on the Contact page. Nothing on the site constitutes an offer or solicitation to buy or sell any security.

The firm offers Alpha Driven Dynamic Global Asset Allocation through Separately Managed Accounts and through the RSAC Portfolio Fund, LP. Investment in either of those vehicles is available only through a direct, written engagement with the firm and, where applicable, through subscription documents and offering materials.

Information on the site is for general educational and informational purposes. It is not personalized investment advice. It is not a recommendation to buy or sell any security, asset class, or strategy. It is not an offer of securities. It is not a substitute for engaging the firm as your advisor.

Investment involves risk, including possible loss of principal. Past performance does not guarantee future results. Strategies that are illustrative on the site may not be suitable for your particular circumstances. Suitability is determined in conversation with the firm.

We make a reasonable effort to keep the site accurate and current. We do not warrant that it is free from errors, omissions, or out-of-date statements. Allocations, illustrative figures, and graphics are exactly that — illustrative. From time to time we publish notes and commentary. Those notes reflect the views of the firm as of the date written. Views, holdings, and positioning may change without notice.

The site, its content, design, code, brand marks, and the Wind & Rose name and logo are owned by or licensed to Wind & Rose. You may read and print pages for your personal, non-commercial reference. You may not copy, modify, redistribute, frame, scrape, or use any part of the site for commercial purposes without our prior written consent.

You agree not to use the site in any way that is unlawful, harmful, or that interferes with its normal operation. That includes attempting to gain unauthorised access to systems, probing for vulnerabilities, submitting false information through the Contact form, automated scraping, or abusing the verification flow.

The site may link to third-party websites or content. We do not control those resources and we are not responsible for their availability, accuracy, or practices. Following a link is at your own discretion.

To the fullest extent permitted by law, Wind & Rose, its members, employees, and affiliates are not liable for any indirect, incidental, consequential, or special damages arising out of your use of the site, including any loss of profits or investment losses. The site is provided on an “as is” basis without warranties of any kind, whether express or implied.

Nothing in these terms is intended to limit any duty Wind & Rose owes to its clients under applicable investment-adviser regulation, which continues to apply to the advisory relationship in full.

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising from your use of the site will be subject to the exclusive jurisdiction of the courts located in the State of New York.

We may update these terms from time to time. When we make a material change we will refresh the effective date below. Your continued use of the site after a change means you accept the updated terms.
